Emerging vector-borne diseases create new public health challenges

ScienceDaily (Nov. 30, 2012) ? West Nile virus, Lyme disease, dengue fever, and plague are examples of "vector-borne zoonotic diseases," caused by pathogens that naturally infect wildlife and are transmitted to humans by vectors such as mosquitoes or ticks.

According to Marm Kilpatrick, who studies the ecology of infectious diseases at the University of California, Santa Cruz, a broad range of human activities can affect the spread of zoonotic diseases. In an article in the December 1 issue of the British medical journal Lancet, Kilpatrick and coauthor Sarah Randolph of the University of Oxford describe how widespread land-use change, globalization of trade and travel, and social upheaval are driving the emergence of zoonotic vector-borne diseases around the world. The article is part of a special series of papers focused on emerging zoonotic diseases.

"This collection of papers offers a bridge between ecologists and clinicians whose combined efforts are needed to address the ongoing challenges of emerging zoonotic diseases," said Kilpatrick, an assistant professor of ecology and evolutionary biology at UC Santa Cruz.

Emerging infectious diseases can be roughly split between introduced and locally emerging diseases. Introduced diseases arise from the spread of a pathogen to a new location, as when West Nile virus arrived in New York in 1999 and subsequently spread across North America. Locally emerging diseases increase in importance in areas where they are endemic, as with Lyme disease in the United States over the past three decades. These two types of emerging diseases can differ markedly with respect to infection dynamics, or the number of cases over time, Kilpatrick said.

"Introduced diseases often cause a big spike in infections and then decrease substantially. Locally emerging diseases often show a steady, sustained increase," he said.

The movement of pathogens by global trade and travel results in the emergence of diseases in new regions. Once established, introduced pathogens often evolve to take advantage of their new environment, including new hosts and vectors. With so much of the landscape shaped by human activities, pathogens may thrive by infecting hosts and vectors that do well in humanmade environments.

"Increasing human population and the urbanization and agricultural intensification of landscapes puts strong selective pressure on vector-borne pathogens to infect humans and be transmitted by vectors and hosts that live around humans," Kilpatrick said.

Emergence of endemic vector-borne diseases can result from changes in land use, such as expansion of people into new habitats, or environmental changes affecting the wild animals that serve as natural hosts or the insect vectors that spread the disease to humans. Although vector-borne diseases are highly sensitive to climate, climate change does not appear to be a major driving force behind emerging diseases, the authors said.

"So far, climate change has been a relatively minor player compared to land use and socioeconomic factors in the emergence of vector-borne disease," Kilpatrick said.

Social and economic changes, ranging from economic downturns to displacement of populations by armed conflict, frequently precipitate disease outbreaks through their impacts on public health systems, sanitation systems, behavioral patterns, and uses of natural environmental resources. One example cited in the article is a large upsurge of tick-borne encephalitis after an economic downturn in eastern Europe resulted in more people harvesting food from forests.

The incidence of any vector-borne disease involves a complex interplay of multiple factors affecting animal hosts, vectors, and people. Kilpatrick and Randolph emphasize that control of these diseases requires combined efforts by clinicians and public health officials to treat patients, promote behavior likely to minimize the risk of infection, and advise on efforts to reverse the ecological drivers of transmission through vector control, urban planning, and ecological restoration.

Publication of the Lancet series coincides with an Institute of Medicine (IOM) symposium on Emerging Infections, Microbial Threats to Health, and the Microbiome, December 11-12 in Washington, D.C. The symposium marks the 20th anniversary of an influential 1992 IOM report on emerging diseases.

"Humans are altering the environment and moving themselves and other organisms around the globe at an ever-increasing pace," said Sam Scheiner, program director for the Ecology and Evolution of Infectious Diseases program at the National Science Foundation (NSF), a joint effort with the National Institutes of Health (NIH). "That has led to a growing disease threat. These papers show how and why that's happening, and what we need to know to ease the disease burden."

Why did Obama invite Romney to lunch?

President Barack Obama is having Mitt Romney over for lunch on Thursday, and their meeting is already generating a lot of buzz. Here are five theories about the White House?s motives.

cspandebateObama and Romney were bitter rivals in the 2012 presidential campaign, with Obama getting a surprisingly big victory in the Electoral College.

Since then, Romney has stayed out of the spotlight, while Obama said he would invite Romney to the White House at some point.

The pair will have a private meeting for lunch, so there will be no press coverage or a photo opportunity.

So here are five theories that are floating around about the get-together.

1. Obama is extending a common courtesy

In 2008, President-elect Obama met with John McCain on November 17 in Chicago, and there was a photo op with the two men. McCain had lost to Obama, but he was still a U.S. senator.

At the time, McCain said he would ?obviously? help the incoming president, and the former foes issued a statement about bipartisanship.

Conditions are different in 2012, with Romney not holding a Senate position and Obama sitting in office as the incumbent.

We?re also not sure that there is a tradition of losing presidential candidates meeting with incumbent presidents.

The protocol for current presidents meeting with former presidents is entirely different.

2. Obama will offer Romney a Cabinet job

That doesn?t seem likely, since Romney is self-supporting financially and has a life outside politics, with 18 grandchildren.

If a job were forthcoming in the new Obama Cabinet, it would have to be approved by the U.S. Senate, with a majority vote.

Since the Senate is controlled by the Democrats, that could get interesting.

Also, as a Cabinet member, Romney would be reporting to Obama, which also would be interesting, given the mutual dislike between the candidates on the campaign trail.

3. Obama will enlist Romney in the fiscal cliff debate

One issue where the candidates disagreed sharply on the campaign trail was on the fiscal cliff debate.

Romney was not in favor of raising taxes on higher income earners, because he believed it stunted the growth of business and hurt its ability to create jobs.

Obama was critical of Romney?s philosophy about the fiscal cliff, especially his attacks on entitlement spending.

However, one of Romney?s ideas on the campaign trail, a cap of income tax deductions for wealthier Americans, might become part of the negotiations in Congress in December.

Obama had floated out a similar plan in the past, but just after the election, Senate Democrats attached Romney?s name to it, as a way to get the Republicans to discuss it.

?Let?s just say there?s a renewed interest,? said Senator Kent Conrad, Democrat of North Dakota and chairman of the Senate Budget Committee, as reported in The New York Times on November 13. ?Part of it is people reflecting on Obama?s proposal, but when Romney said what he said, it just added fuel.?

4. Obama wants Romney?s advice on business issues

That?s also a distinct possibility, since President Obama praised Romney?s business acumen after the campaign.

?He presented some ideas during the course of the campaign that I actually agree with. And so it?d be interesting to talk to him about something like that. There may be ideas that he has with respect to jobs and growth that can help middle-class families that I want to hear,? Obama said.

Of course, President Obama has scores of business advisers already, including friends in the private sector.

5. Obama wants closure on the 2012 presidential election, or something else?

President Obama said after the election that he was interested in talking with Romney about ways the two men could work together.

He used similar words about John McCain in 2008, after Obama easily defeated the Republican candidate. That didn?t come to pass.

One theory is that Obama could just want to be consistent in how he publicly handles his consecutive wins in 2008 and 2012, and it would be a slight to Romney if he didn?t extend a similar invitation for a sit-down meeting.

But in an editorial in Wednesday?s Washington Post, former Romney strategist Stuart Stevens paints a portrait of Romney as a good man who is a Washington outsider, who was never accepted by the GOP establishment.

?I appreciate that Mitt Romney was never a favorite of D.C.?s Green Room crowd or, frankly, of many politicians. That?s why, a year ago, so few of those people thought he would win the nomination,? Stevens said.

Given that some key Republican leaders criticized Romney for his post-election comments about Obama using ?gifts? to win the election, could Obama approach Romney about some kind of position related to bipartisanship or public service?

As odd as the idea sounds, Romney has made it clear he?s done running for public office, but has no plans to retire.

An Associated Press story earlier this month cited a Romney insider as saying the former candidate had an interest in philanthropic efforts or having a role in future Olympics efforts.

U.S. Pushes to Keep Entrepreneur Jobs in the Country

?

The Obama administration's top immigration official is visiting the Massachusetts Institute of Technology to unveil an online resource intended to help entrepreneurs navigate their immigration options.

U.S. Citizenship and Immigration Service Director Alejandro Mayorkas will unveil so-called "Entrepreneur Pathways" on Wednesday.

It is a key product of "Entrepreneurs in Residence" program that brings in business experts from outside government to look for better ways to apply existing immigration laws. The initiative, launched during a meeting with members of Silicon Valley's startup community in February, seeks to keep foreign-born, high-tech entrepreneurs in the U.S.

The tech industry typically complaint that non-citizens who come to the country often hit immigration obstacles when they try to start companies.

The immigration service says it wants to streamline the immigration process for entrepreneurs to help keep jobs on U.S. soil.

'Two and a Half Men' actor apologizes

NEW YORK (AP) ? Teenage actor Angus T. Jones of the comedy "Two and a Half Men" apologized Tuesday for a series of interviews denouncing his own show, an episode that has rivaled former colleague Charlie Sheen's meltdown as an off-screen oddity.

Speaking to religious media outlets, the 19-year-old Jones has called the CBS comedy "filth" and "very inappropriate" and talked about how his religious awakening has affected his attitude toward life and work.

"Two and a Half Men," television's third most popular comedy, remains heavy on sexual innuendo even with Ashton Kutcher replacing bad-boy Sheen following his firing for drug use and a subsequent public meltdown. Jones, who started on the show when he was 10, plays Jake Harper, son of the uptight character portrayed by Emmy winner Jon Cryer.

In a statement issued late Tuesday, Jones said he had the highest regard for all of the people he has worked with on the comedy, including creator Chuck Lorre and Warner Bros. studio chief Peter Roth.

"I apologize if my remarks reflect me showing indifference to and disrespect of my colleagues and a lack of appreciation of the extraordinary opportunity of which I have been blessed," said Jones, who reportedly makes $350,000 an episode. "I never intended that."

Jones wasn't at the studio lot for a rehearsal on Tuesday. He's not scheduled to appear on the two episodes that are being filmed before the end of the year, said a person close to the show who spoke on condition of anonymity because Warner Bros. and CBS haven't commented publicly on Jones. His character has recently joined the Army and his airtime has been cut down.

His real-life adventure came to light on Monday, when he said in a video posted by the Forerunner Chronicles in Seale, Ala., featured him talking about not wanting to be on "Two and a Half Men" anymore.

"Please stop watching it," Jones said. "Please stop filling your head with filth."

In a radio broadcast, "The Voice of Prophecy," recorded for the Seventh-day Adventist Church on Jones' birthday in October, Jones described his religious path. He has been attending a Seventh-day Adventist Church in the Los Angeles area.

Jones said he felt drawn to God after a tough time in his life when his parents were going through a divorce and he experimented with drugs.

"I never drank," he said. "That was one thing God protected me from, and I'm still a virgin. God protected me from those things."

Jones said that "it's very weird that I'm on a television show, especially now that I am trying to walk with God. My television show has nothing to do with God and doesn't want anything to do with God." Still, he said he had no plans to get out of his contract.

In another interview posted on Tuesday with Christianity Today, Jones described himself as a "paid hypocrite."

"Even though it's my job to be an actor, I have given my life to God," he said. "I am very comfortable and firm in that, but I still have to be on this show. It's the No. 1 comedy, but it's very inappropriate and the themes are very inappropriate. I have to be this person I am not."

"Two and a Half Men," which has seen its ratings tumble this fall with a move to Thursdays, is now behind "The Big Bang Theory" and "Modern Family" in the comedy ratings.

Trump Teases With A First Look At The Old Post Office Building In DC

Back in February when it was first announced that Trump Hotels would be taking over the Old Post Office Building in DC, Ivanka Trump told reporters: "I think the historic facade of the building will be the greatest signage of all."

Which might very well be true, but judging from these new renderings released yesterday via the Washington Post, it seems the idea of a Trump Hotel minus any Trump signage just didn't sit too well with ol' Donald. One of the most visible features in the renderings is a horizontal banner that will hang under the iconic building's domed entrance reading "Trump International Hotel."

Nevermind the fact that 90% of the city is going to know it's his hotel anyway, but...yeah. Branding. We get it.

Trump will also re-open a previously closed section of 11th St, and that street will also contain a monolith bearing the 'Trump International Hotel' name. There goes the neighborhood!

Previously, we had heard that the Trump-ified building would also include a spa, restaurants, and even a museum dedicated to the building's history. While none of that is confirmed yet, it looks like the ground floor will indeed be entirely devoted to retail space and restaurants, while an additional restaurant and bar will go above, on the first floor.

The Trumps will also be adding a new mezzanine level within the building, so that guests can enjoy the building's gorgeous atrium-style design when the look up.

But before you get your hopes up, keep in mind this hotel hasn't even begun construction yet. According to the Washington Post article, Donald, Ivanka and the architects are still very much in the planning phase, with an estimated completion date of 2016.

Reminder: The aggregate cost includes the employer and employee shares of group health insurance that?s excludable from employees? incomes under tax code Section 106. Use the COBRA valuation, minus the 2% surcharge.

Last week Forex trading was done in unusual conditions. On Thursday Thanksgiving Day was celebrated in the USA.? That is why many investors began to leave the market and returned to the monitors only on Monday. Thus, Forex market became a thin market by the end of the week. High profit currency managed to avail itself of the opportunity. The euro attacked the dollar and approached to 1.3000. It was mostly caused by the expectations of Greek aid tranche which may be approved by the Ministers of Finance of the euro zone at today?s meeting. The unified currency was also supported by the reports published during the week, which mostly represented better-then-expected results. What are the perspectives of the EUR/USD currency pair for the last week of autumn? Of course, if the Greek tranche is approved, the euro will most likely continue growing and then the euro will aimed to break out above 1.3000. But we can?t rule out the possibility of another scenario. Firstly, there are no guarantees good results of today?s meeting (let?s remember Merkel?s words on disagreements over Greek problems).Secondly, even if the ministers approve the next aid tranche, it need to be approved by the Parliaments of many countries, including Germany (the Parliamentary voting will be on the 30thof November). If not, the euro may lost everything it has got without difficulties in thin market. The GBP/USD currency pair also broke out last week. By the way, the pound managed to get an important technical victory: to return above key resistance ? the Gann line which begins from the summer low (which is red on the chart). It became a kind of ?restoration of justice?: after all the EUR/USD manages to hold up above the same line on its chart. Meanwhile, the UK economy doesn?t look worse than the economy of E-17! And published protocol of the last meeting of the bank of England confirmed that the quantitative easing implemented by the Central Bank is not expected this year. So, from this point of view the pound looked re-sold lately. This week the GBP/USD dynamics will depend on the fact whether this currency pair will manage to fix above achieved level. If it returns under 1.6000, it will create a threat to downward movement.

30 Years of Breast Screening: 1.3 Million Wrongly Treated | Pakalert ...

The breast cancer industry?s holy grail (that mammography is the primary weapon in the war against breast cancer) has been disproved. In fact, mammography appears to have CREATED 1.3 million cases of breast cancer in the U.S. population that were not there.

A disturbing new study published in the New England Journal of Medicine is bringing mainstream attention to the possibility that mammography has caused far more harm than good in the millions of women who have employed it over the past 30 years as their primary strategy in the fight against breast cancer.[i]

Titled ?Effect of Three Decades of Screening Mammography on Breast-Cancer Incidence,? researchers estimated that among women younger than 40 years of age, breast cancer was overdiagnosed, i.e. ?tumors were detected on screening that would never have led to clinical symptoms,? in 1.3 million U.S. women over the past 30 years. In 2008, alone, ?breast cancer was overdiagnosed in more than 70,000 women; this accounted for 31% of all breast cancers diagnosed.?

As we revealed in a previous article,[ii] the primary form of mammography-detected breast cancer is ductal carcinoma in situ (DCIS), also known as ?stage zero? or ?non-invasive breast cancer.? Unlike truly invasive cancer, which expands outward like the crab after which it was named (Greek:? Cancer = Crab), ductal carcinoma is in situ, i.e. situated, non-moving ? an obvious contradiction in terms.

Also, DCIS presents without symptoms in the majority of women within which it is detected, and if left untreated will (usually) not progress to cause harm to women. Indeed, without x-ray diagnostic technologies, many if not most of the women diagnosed with it would never have known they had it in the first place. The journal Lancet Oncology, in fact, published a cohort study last year finding that even clinically verified ?invasive? cancers appear to regress with time if left untreated:

[We] believe many invasive breast cancers detected by repeated mammography screening do not persist to be detected by screening at the end of 6 years, suggesting that the natural course of many of the screen-detected invasive breast cancers is to spontaneously regress.[iii]

The new study authors point out ?The introduction of screening mammography in the United States has been associated with a doubling in the number of cases of early-stage breast cancer that are detected each year.? And yet, they noted, only 6.5% of these early-stage breast cancer cases were expected to progress to advanced disease. DCIS and related ?abnormal breast findings,? in other words, may represent natural, benign variations in breast morphology. Preemptive treatment strategies, however, are still employed today as the standard of care, with mastectomy rates actually increasing since 2004.[iv]

The adverse health effects associated with overdiagnosis and overtreatment with lumpectomy, radiation, chemotherapy and hormone-suppressive treatments cannot be underestimated, especially when one considers the profound psychological trauma that follows each stage of diagnosis and treatment, and the additional physiological burdens such psychic injuries lead to, including up-regulation of multidrug resistance genes within cancer as a result of the increased adrenaline associated with the ?flight-or-fight? stress response.[v]

Also, it is now coming to light that chemotherapy and radiation actually increase the proportion of the highly malignant cancer stem cells to the relatively non-malignant daughter cells within the tumor colony. Much in the same way that conventional antibiotic agents will drive multidrug resistance within the subpopulation of surviving post-antibiotic bacteria, ensuring recurrence, conventional treatments also drive the surviving stem-cell enriched tumor populations into greater resistance and metastatic potential when it does inevitably recur. Or worse, radiation therapy may actually increase the ?stemness? of breast cancer cells making them 30 times more malignant (capable of forming new tumors).

If it is indeed true that DCIS, other abnormal breast findings, as well as clinically confirmed invasive breast cancer, either remain benign or regress when left untreated, the entire breast cancer industry, which is already deeply mired in cause-marketing conflicts of interest, must radically reform itself, or face massive financial and ethical liabilities vis-?-vis outdated and no longer ?evidence-based? practices.

Another serious problem with mammography (and there are dozens of them) not addressed in this latest research finding concerns the unique carcinogenicity of the x-rays the technology employs. We now know that the 30 kVp radiation, colloquially known as ?low energy? x-rays, are between 300-400% more carcinogenic than the ?higher energy? radiation given off by atomic bomb blasts (200 kVp or higher).[vi]? Present day radiation risk models used to assess the known breast cancer risk associated with mammography against the purported benefits do not take into this profound discrepancy. In fact, these models were developed before DNA was even discovered.

Also, considering that breast cancer susceptibility genes, BRCA1/BRCA2, interfere with the DNA self-repair mechanisms needed to reduce the carcinogenicity associated with radiation exposure within those who carry these genetic variations, the harms associated with mammography may be exponentially higher than the conventional medical community presently understands and communicates to their patients.? Indeed, it is likely that x-ray based mammography screenings have been planting the seeds of future radiation-induced breast cancer within exposed populations.

With top-tier biomedical journals now publishing research diametrically opposed to the policies and recommendations of both governmental, non-governmental and industry-sponsored health organizations, the time is ripe for us to critically evaluate conventional medicine?s conventional standard of care and to educate ourselves further to the true causes of cancer, and how to go about preventing and/or removing them.

Housing May Be Stable, but Not in 'Full-Blown ... - Yahoo! Finance

Housing has been trying to show a few reasons here and there to suggest the sector's worst days are behind it, but you still won't necessarily find a lot of uber-bulls out there.

Now, several stocks in the group have had good runs in 2012, led by PulteGroup (PHM), the best performer on the S&P 500 with a gain of 165.5% since the start of the year. Lennar (LEN) has been another star, climbing 93.9% and coming in at No. 5 on the list, FactSet data show.

However, regardless of the state of the stocks, there remain plenty of skeptics on housing who are questioning just exactly how healthy it is. Barry Ritholtz, CEO of FusionIQ and founder of the blog The Big Picture, sees some of each side of the argument.

"Currently, housing is one of the few bright spots in the economy," he says in the attached video. "The problem with housing continues to be it's not an organic recovery, or stabilization, to use a better word. The [Federal Reserve has] driven rates down to inconceivable levels."

Foreclosures, Ritholtz says, are now rising after banks had put many of them on hold to sort out the robo-signing debacle, and he's "expecting that to continue to gather momentum."

"I'm comfortable saying housing has stabilized, but I'm not buying the 'we're in a full-blown recovery' meme," he says.

By spring, we should know which side is right on housing -- that is, whether a legitimate turn is upon the market or more weakness lies ahead, he says.

Investors, economists and homeowners themselves have no shortage of data to scour every month. Earlier this week, for example, the Commerce Department reported that housing starts rose in October to a seasonally adjusted yearly pace of 894,000, up 3.6% from the prior month. Apartment construction was the strong metric, while single-family home builds eased slightly. However, single-family construction permits were at a multi-year high.

Attorney General Seeks Tax Break, Debt Relief for Homeowners ...

Attorney General George?Jepsen?is leading a national effort by state attorneys general who are urging Congress to extend tax relief for consumers who have mortgage debt canceled or forgiven because of financial hardship or a decline in housing values.

Jepsen?co-authored a letter with Florida Attorney General Pamela Bondi, which was signed onto? by 40 other attorneys general and sent today to U.S. House and Senate leaders. It asked the leaders to extend the exclusion, which has been in effect since 2007, and which will otherwise expire on Dec. 31, 2012.

The expiration comes at a time when many homeowners nationwide are benefitting from the $25 billion national settlement agreement with the nation?s five largest loan servicing companies, which provides $17 billion in debt reduction and other relief to homeowners. Many other banks across the country also offer mortgage modification and debt relief programs.

?I urge Congress to extend this critical tax exclusion so that the very families who can least afford it are not stuck with an unexpected tax bill or deterred from participating in this historic settlement,? Attorney General?Jepsen?said. ?Extension of this tax exclusion is estimated to save taxpayers some $1.3 billion over two years.?

Under the federal Mortgage Debt Relief Act, in effect since 2007, mortgage debt that is forgiven after a foreclosure or short sale or through a loan modification provided to a homeowner in financial hardship may be excluded from a taxpayer?s calculation of taxable income. This exclusion only applies to mortgage debt forgiven on primary residences, not second homes.

?These mortgage modification and debt relief programs provide real relief to homeowners fighting to keep their homes or trying to get back on their feet,? Jepsen?said. ?Unless Congress acts, any debt relief to be provided in 2013 under the National Mortgage Settlement, as well as other mortgage debt relief programs, will likely be considered taxable income.?

An extension is included in the Family and Business Tax Cut Certainty Act of 2012 (S. 3521), which recently passed out of the Senate Finance Committee with bipartisan support.

Attorney General?Jepsen?is a member of the executive committee of attorneys general who helped to negotiate the $25 billion federal-state settlement agreement with the five largest mortgage loan servicing companies and continue to oversee the banks compliance. The agreement, announced in February, took effect in April.

Analysis: Charges against BP employees test reach of U.S. statute

NEW YORK (Reuters) - Not all manslaughter charges are created equal. If they were, the U.S. Justice Department might have filed just 11 charges when it brought a criminal case against two BP Plc employees last week, one for each of the 11 deaths in the Deepwater Horizon disaster.

Instead, the government charged Robert Kaluza and Donald Vidrine, the two highest-ranking BP supervisors on board the rig in the hours before the 2010 disaster, with 11 counts of involuntary manslaughter and 11 counts of what's known as seaman's manslaughter.

The seaman's manslaughter statute was first passed by Congress in 1838 after a string of deadly steamboat accidents. The law, which has been modified multiple times since then, was intended to hold captains, engineers and pilots responsible for deaths attributable to their conduct.

The idea behind the law was that those operating a ship have a special responsibility toward passengers in their care. As The Wall Street Journal and others have noted, prosecutors face a lower bar in proving seaman's manslaughter than they do in ordinary manslaughter cases. Manslaughter charges generally require a finding of gross negligence; seaman's manslaughter does not.

The U.S. Court of Appeals for the 5th Circuit affirmed that distinction in a 2005 case, U.S. v. O'Keefe, which could be key precedent in the BP case. The O'Keefe case resulted in the seaman's manslaughter conviction of a tugboat captain whose wife drowned in the Mississippi River after the vessel capsized. At trial, the government introduced testimony indicating that the captain had ingested cocaine on the day of the accident. Prior to deliberations, the captain's lawyer asked that the jury be instructed that the government must show the accident was a result of "gross negligence," defined as "wanton or reckless disregard for human life."

U.S. District Judge Helen Berrigan in New Orleans disagreed, ruling that the statute requires only a finding of negligence, which she defined as an "omission to perform some duty" or a "violation of some rule or standard of care, which is made to govern and control one in the discharge of some duty." The 5th Circuit upheld her ruling and the captain's conviction.

But the 5th Circuit decision left unanswered the question of whether the government can assert seaman's manslaughter against Kaluza and Vidrine at all. The two are accused of failing to alert engineers onshore that BP's Macondo well was unstable and of accepting "illogical" explanations from members of the rig crew for the warning signs. In the indictment, prosecutors allege the two men violated the seaman's manslaughter statute by engaging in "negligence" and "inattention" to their duties.

Here's what the seaman's manslaughter statute says: "Every captain, engineer, pilot or other person employed on any steamboat or vessel, by whose misconduct, negligence or inattention to his duties on such vessel the life of any person is destroyed ... shall be fined under this title or imprisoned not more than ten years, or both."

Vidrine and Kaluza were not captains or engineers of the Deepwater Horizon. The two have been described by investigators, including those who wrote the "Chief Counsel's Report" on the Deepwater disaster, as "well site leaders." According to the report, well site leaders served as BP's "eyes and ears, and made important decisions regarding the course of drilling operations." As the litigation against Vidrine and Kaluza progresses, a judge may have to decide whether "well site leaders" should fall within the "other person" category covered by the seaman's manslaughter statute.

A search of the database of legal research service Westlaw shows the statute has rarely been used in the last decade, and when it has, it has mostly been against defendants who were responsible for navigating a vessel. In the case of the convicted tugboat captain, neither the trial judge nor the 5th Circuit addressed who is covered under the statute, but Judge Berrigan emphasized the statute's purpose of holding responsible those in charge of navigation.

"In light of the unique dangers of maritime travel, the vulnerability of passengers on board such vessels and the voluntary nature of employment or ownership, it is reasonable to impose on such crews a heightened degree of care with the parallel lower threshold for criminal liability," she wrote.

It may be a long shot for Vidrine and Kaluza to argue that the seaman's manslaughter statute does not apply to them, but it's probably one worth taking. Vidrine counsel Robert Habans of Habans & Carriere and Kaluza lawyer Shaun Clarke of Gerger & Clarke both declined to comment. They have previously said their clients are innocent and have been unfairly targeted by the government.

New York Theatre - Entertainment - Interviews - Actors - Actresses ...

There's a new composer on the rise and his name is Will Reynolds! I had first seen Will in NYMF's Baby Case?this past summer and was very taken by his performance and on November 11, 2012, I was introduced to Will Reynolds the composer in Libra Theater's presentation of Poems and Moon Songs: The Music of Will Reynolds at the Underground Lounge in NYC.

Will's style of music is very unique because he takes poems and sets them to music in addition to writing his own original songs. I was blown away by the humor, heart, and sophistication Will put into his lyrics and music. Will has a natural knack for telling stories of love and loss through song, some consisting of a comedic nature.?A terrific cast of talent was put together for this wonderful evening of music:?Sara Jean Ford, Marissa McGowan, Jeremy Morse, and Zachary Prince hit all the right notes throughout the evening.

My favorite songs of the night were "Heartsong" sung by the whole cast (based upon the poem by Mattie Stepanek), "Can't Fall Asleep" sung by Marissa, "Heart, We Will Forget Him" sung by Sara/Marissa, "Hope" sung by Zachary, (both songs based upon poems by Emily Dickinson), "Si Vous Me Suivez" sung by Jeremy, and "Winter, Wait for Me" and "Spring" sung by Sara. All of these songs struck a chord with me because they reflected the many moods of love/loss I have experienced. I also particularly liked how the songs were sung with big voices, control, and lots of love and enthusiasm!

I'm thrilled to have been able to part of this evening. In addition to seeing some great new talent and experiencing Will's music for the first time, profits from the evening went to Mayor's Fund to Advance New York City, for Hurricane Sandy relief.?

Will's music and style is definitely going to bring a new dimension to whatever medium he uses it in (here's hoping it's theatre).?
